Regulation of the Ministry of Development ensures basic aid for farmers who have outstanding issues with the Land Registry

In which cases active farmers will not be excluded from the payment

The Ministry of Rural Development and Food announces that it is taking an initiative to regulate the redress of injustices faced by active farmers who, while cultivating agricultural land and meeting the eligibility requirements, were deprived of basic payment due to the non-completion of the process of registering their rights in the Land Registry.

The regulation aims to ensure that these producers are not excluded from receiving aid, solely because:

– the registration of ownership titles (such as concessions from reparceling or distributions) has not yet been completed,
– the transfer or ratification/issuance of an administrative transfer of ownership by the State establishing rights to agricultural land is pending,
– A decision has been issued by the Committee for the Examination of Objections in the context of cadastral registration, which recognises a right in rem in favour of the producer, but this decision has not yet been incorporated into the Land Registry data, due to the non-completion of the procedure for posting the original records for the area.

The regulation will introduce a transitional mechanism of presumptive eligibility for these farmers, based on:

– on administrative or notarial documents, titles and deeds,
– acceptance of an objection or opposition by the competent Land Registry Committee,
– data from the OSSD declarations and other evidence of actual cultivation.

In this way, the State ensures the temporary recognition of rights until the relevant procedures in the Land Registry are completed, preventing the unjustified exclusion of beneficiaries from payments to which they are demonstrably entitled.
